MEASURES FOR THE SUPERVISION AND ADMINISTRATION OF INSPECTION AND QUARANTINE OF IMPORT AND EXPORT FEED AND FEED ADDITIVES

Chapter I General Provisions
Article 1 These Measures are formulated to standardize inspection, quarantine, supervision and administration of import and export feed and feed additives, improve their safety level, and protect animal and human health under applicable Chinese laws and regulations.
Article 2 These Measures apply to inspection, quarantine and supervision of feed and feed additives entering or leaving China.
Article 3 GACC is responsible for nationwide administration; competent Customs offices perform supervision within their jurisdictions.
Article 4 GACC implements risk-based and categorized administration of import and export feed and feed additives.
Article 5 Import and export enterprises shall comply with laws, regulations and relevant standards and are responsible for product safety.
Chapter II Import Inspection and Quarantine
Article 6 GACC implements quarantine access for countries/regions exporting feed and feed additives to China and may conduct risk analysis and assessment of their regulatory systems.
Article 7 Where necessary, GACC and the competent authority of the exporting country/region determine inspection and quarantine requirements through protocols, agreements, memoranda or other arrangements.
Article 8 GACC implements registration administration for overseas production, processing and storage establishments where required.
Article 9 Overseas establishments shall be recommended by the competent authority of the exporting country/region and shall meet Chinese requirements.
Article 10 Registered establishments shall continuously comply with registration and safety requirements and remain under effective official supervision.
Article 11 Importers shall file or complete other required Customs formalities and establish product traceability records.
Article 12 Products subject to entry animal and plant quarantine approval shall obtain an Entry Animal and Plant Quarantine Permit before import as required.
Article 13 Importers or agents shall truthfully declare goods and submit official certificates, contracts, invoices, packing lists and other required documents.
Article 14 Customs shall verify documents and may conduct on-site inspection, sampling and laboratory testing according to risk.
Article 15 Imported feed and feed additives shall comply with Chinese laws, regulations, national standards and agreed inspection and quarantine requirements.
Article 16 Products containing animal-derived ingredients shall comply with applicable animal quarantine requirements.
Article 17 Plant-derived products shall be free from quarantine pests, soil and other prohibited materials and shall meet phytosanitary requirements.
Article 18 Genetically modified ingredients shall comply with China's laws and approval requirements.
Article 19 Packaging and labels shall comply with Chinese feed labeling, safety and quarantine requirements.
Article 20 Products passing inspection and quarantine shall be permitted entry.
Article 21 Non-compliant products shall, depending on the nature of the problem, be treated, returned, destroyed or otherwise disposed of under Customs supervision.
Article 22 Where serious safety or quarantine problems occur, GACC may strengthen inspection, suspend imports from relevant establishments or areas, or take other emergency measures.
Chapter III Export Inspection and Quarantine
Article 23 Export feed and feed additives shall comply with requirements of the importing country/region and relevant Chinese provisions.
Article 24 Export production enterprises shall establish effective safety and hygiene control and traceability systems.
Article 25 Where the importing country/region requires registration or recommendation, Customs shall organize relevant procedures.
Article 26 Exporters shall truthfully declare goods and provide required documents.
Article 27 Customs shall conduct inspection and quarantine according to importing-country requirements, bilateral agreements and Chinese rules.
Article 28 Products passing inspection and quarantine shall be issued relevant certificates where required; non-compliant products shall not be exported unless properly rectified and re-inspected.
Article 29 Enterprises shall cooperate with overseas notification investigations, recalls and corrective actions.
Chapter IV Risk Management and Supervision
Article 30 GACC collects and analyzes safety, quarantine and overseas notification information and dynamically adjusts risk-control measures.
Article 31 Customs may implement differentiated inspection frequencies according to product risk and enterprise credit.
Article 32 Importers, exporters and production establishments shall retain traceability, testing, production, storage and sales records as required.
Article 33 Where safety incidents or major non-compliance occur, enterprises shall immediately report and take control measures.
Article 34 Customs may inspect production, processing, storage and transport premises and review relevant records.
Article 35 Relevant enterprises shall cooperate with Customs supervision and shall not conceal, falsify or refuse to provide information.
Article 36 GACC may notify the competent authority of the exporting country/region and request investigation and corrective measures where imported products repeatedly fail requirements.
Chapter V Legal Liability and Supplementary Provisions
Article 37 Violations shall be handled under the Entry and Exit Animal and Plant Quarantine Law, Import and Export Commodity Inspection Law and other applicable laws and regulations.
Article 38 Enterprises obtaining registration, filing or other qualifications through fraud may have such qualifications cancelled or revoked and may be subject to penalties.
Article 39 Customs personnel violating laws or abusing authority shall be held accountable according to law.
Article 40 GACC is responsible for interpretation of these Measures.
Article 41 These Measures and subsequent amendments shall be implemented according to their respective effective dates.
