MEASURES FOR THE ADMINISTRATION OF QUARANTINE APPROVAL FOR ENTRY ANIMALS AND PLANTS

Chapter I General Provisions

Article 1 These Measures are formulated to strengthen administration of quarantine approval for entry animals and plants and prevent the introduction of animal infectious and parasitic diseases, dangerous plant pests, weeds and other harmful organisms.

Article 2 These Measures apply to entry animals, animal products, plants, plant products and other quarantine objects for which quarantine approval is required under the Entry and Exit Animal and Plant Quarantine Law, its implementing regulations and other state provisions.

Article 3 GACC uniformly administers quarantine approval nationwide.

Article 4 Quarantine approval follows the principles of risk management, openness, fairness and convenience while safeguarding biosecurity.

Article 5 Applicants shall be legal persons or other organizations capable of assuming relevant quarantine responsibilities.

Chapter II Application

Article 6 An applicant shall apply for quarantine approval before signing the relevant trade contract where required by law.

Article 7 Application materials shall truthfully state the commodity, species, quantity, origin, intended use, entry port, destination, transport route, storage/isolation premises and other required information.

Article 8 For products requiring designated isolation, processing or storage premises, the premises shall meet Customs quarantine and biosafety conditions.

Article 9 Where the exporting country/region, commodity or establishment has not obtained required quarantine access, an approval application may not be accepted or approved until access requirements are met.

Article 10 Applicants shall provide supplementary technical materials when required for risk assessment.

Chapter III Examination and Approval

Article 11 Customs examines application materials and may verify relevant premises and conditions.

Article 12 GACC or authorized Customs offices shall make an approval decision within the statutory period where conditions are met.

Article 13 Approved applications are issued an Entry Animal and Plant Quarantine Permit or other prescribed approval document.

Article 14 Where an application fails to meet quarantine requirements, approval shall not be granted and reasons shall be stated.

Article 15 A quarantine permit is valid only for the approved commodity, origin, quantity, use, port, destination and validity period.

Article 16 Where approved matters change, the applicant shall apply for modification or re-approval as required before import.

Article 17 Quarantine approval may be suspended or revoked where animal/plant epidemic conditions, pest risks or other biosecurity circumstances materially change.

Chapter IV Supervision and Administration

Article 18 Importers shall organize import within the permit validity period and according to approved conditions.

Article 19 The permit number and relevant approval information shall be truthfully declared to Customs.

Article 20 Customs shall verify whether imported goods correspond to approved matters.

Article 21 Goods imported without required approval or inconsistent with approval shall be handled under the Entry and Exit Animal and Plant Quarantine Law and its implementing regulations.

Article 22 Applicants shall cooperate with Customs supervision and provide truthful records and information.

Article 23 Fraud, alteration, transfer or misuse of quarantine approval documents is prohibited.

Article 24 GACC may adjust approval conditions based on risk analysis and changes in epidemic or pest status.

Chapter V Supplementary Provisions

Article 25 Special approval requirements for transit animals, germplasm, biological materials and other high-risk quarantine objects shall follow relevant provisions.

Article 26 GACC is responsible for interpretation of these Measures.

Article 27 These Measures and subsequent amendments shall take effect according to their respective promulgation provisions.
