     An overseas production enterprise of imported food shall obtain the registration of the General Administration of Customs, and the General Administration of Customs of China shall be responsible for the registration and management of overseas production enterprises of imported food

    A、Which companies need to register for imported food overseas production companies

    1. Starting from January 1, 2022, all overseas production, processing, and storage companies exporting food to China will need to register for overseas food production companies;

    2. Production, processing and storage enterprises exporting food additives and food-related products to China do not need to register for overseas food production enterprises.

    B、How to apply for the registration of an overseas production enterprise for imported food

    1. The following 18 categories of imported food overseas production enterprises shall be recommended by the competent authority of the country (region) where they are located to the General Administration of Customs of China for registration:

    Meat and meat products, casings, aquatic products, dairy products, bird's nest and bird's nest products, bee products, eggs and egg products, edible fats and oils, stuffed pasta, edible grains, grain milling industrial products and malt, fresh and dehydrated vegetables, and Dried beans, seasonings, nuts and seeds, dried fruits, unroasted coffee beans and cocoa beans, special dietary foods, health foods.

    2. Enterprises that import overseas food products other than the above 18 categories of food may apply for registration to the General Administration of Customs of China by themselves or by entrusting their agents.

    An overseas manufacturer of imported food, after review and inspection by the competent authority of the country (region) where it is located, will recommend registration to the General Administration of Customs and submit the following application materials:

    1. Recommendation letter from the competent authority of the country (region) where you live;

    2. List of companies and application for company registration;

    3. Enterprise identification documents, such as business license issued by the competent authority of the country (region) where it is located;

    4. A statement recommended by the competent authority of the country (region) where the company meets the requirements of this regulation;

    5. The review report of the competent authority of the country (region) where the company is located for review and inspection of relevant enterprises.

    6. Enterprise food safety, sanitation and protection system documents, such as the floor plan of the enterprise plant, workshop, and cold storage, as well as the process flow chart, etc.

    1. Application for company registration: The content should include the name of the company, the country (region) where it is located, the address of the production site, the legal representative, contact person, contact information, the registration number approved by the competent authority of the country (region), the type of food to be registered, Information such as production type, production capacity, etc.

    2. Enterprise identification documents, such as business license issued by the competent authority of the country (region) where it is located;

    3. A statement that the company promises to meet the requirements of this regulation.

    E、What are the 18 types of foods that adopt the "official recommended registration" model?

    The following overseas food production companies need to be recommended to the customs by the competent authority of the country (region) where they are located: meat and meat products, casings, aquatic products, dairy products, bird’s nest and bird’s nest products, bee products, eggs and egg products, edible fats and oils, packaging Stuffed pasta, edible grains, grain milling industrial products and malt, fresh and dehydrated vegetables, dried beans, seasonings, nuts and seeds, dried fruits, unroasted coffee beans and cocoa beans, special dietary foods, and health foods.

    F、Why is the "official recommendation registration" model implemented for 18 categories of food?

    Based on the analysis of food raw material sources, production and processing technology, food safety historical data, consumer groups, eating methods and other factors, combined with international practices, the customs has determined that overseas production enterprises of 18 categories of food adopt the "officially recommended registration" model.

    G、 What materials need to be provided for registration of 18 categories of food production enterprises?

    The competent authority of the country (region) where the imported food production company is located will review and inspect the company recommended for registration. After confirming that it meets the requirements, it will recommend registration to the customs and submit the following application materials:

    1. Recommendation letter from the competent authority of the country (region);

    2. List of companies and application for company registration;

    3. Enterprise identification documents, such as business license issued by the competent authority of the country (region) where it is located;

    4. A statement recommended by the competent authority of the country (region) where the company meets the requirements of this regulation;

    5. The review report of the competent authority of the country (region) in which the relevant enterprise is audited and inspected;

    6. When necessary, the General Administration of Customs may request documents of the company's food safety, hygiene and protection system, such as the floor plan of the company's factory area, workshop, and cold storage, as well as process flow diagrams, etc.

    H、What are the registration management and evaluation procedures for manufacturing enterprises?

    1. The customs itself or entrusts relevant agencies to organize an evaluation team to conduct evaluation and review of overseas manufacturers of imported food applying for registration through written inspections, video inspections, on-site inspections and other forms and combinations thereof. The overseas production enterprises of imported food and the competent authorities of the host country (region) assist in the above evaluation and review work.

    2. According to the assessment and review, the customs shall register the overseas production enterprises of imported food that meet the requirements and give the registration number in China, and notify the competent authority of the country (region) or the overseas production enterprise of imported food in writing; for imported food that does not meet the requirements overseas The production enterprise shall not be registered, and shall notify the competent authority of the country (region) where it is located or the overseas production enterprise of imported food in writing.

    I、What should I do if the registration information changes during the validity period of the registration?

    During the validity period of the registration, if the registration information of an overseas production enterprise of imported food changes, it shall submit a change application to the customs through the registration application channel and submit the following materials:

    1. A comparison table of registered item change information.

    2. Proof materials related to the changed information. If the customs considers that it can be changed after evaluation, it shall be changed.

    3. If the production site is relocated, the legal representative is changed, or the registration number granted by the country (region) is changed, the registration number should be re-applied, and the registration number in China will automatically become invalid.

    J、What should an enterprise do if it needs to renew its registration?

    An enterprise shall submit an application for renewal of registration to the General Administration of Customs through the registration application channel within 3 to 6 months before the expiration of the registration validity period. The application materials for renewal of registration include: (1) Application for renewal of registration. (2) A statement that promises to continue to meet the registration requirements. The customs renews the registration of enterprises that meet the registration requirements, and the validity period of the registration is extended by 5 years.
