Dairy-Access procedures

I. GACC Acceptance Conditions 

1. The food safety management system of the host country (region) has passed the equivalent assessment and review of the General Administration of Customs.

2. Established with the approval of the competent authority of the country (region) and under its effective supervision;

3. Establish an effective food safety and hygiene management and protection system, produce and export legally in the host country (region), and ensure that the food exported to China complies with relevant Chinese laws and regulations and national food safety standards;

4. It meets the relevant inspection and quarantine requirements agreed between the General Administration of Customs and the competent authorities of the country (region) where it is located. 

II. Application, acceptance, evaluation, review and decision of registration 

1. Apply for

Overseas production enterprises of meat and meat products shall be examined and inspected by the competent authorities of the country (region) where they are located. After confirming that they meet the registration requirements, they shall recommend and submit the application materials to the General Administration of Customs. 

18 types of products (including meat and meat products, casings, aquatic products, dairy products, bird's nest and bird's nest products, bee products, egg and egg products, edible fats and oils, stuffed pasta, edible grains, grain flour industrial products and malt, fresh and dehydrated vegetables and dried beans, seasonings, nuts and seeds, dried Overseas production enterprises of coffee beans and cocoa beans, special dietary foods and health food shall be examined and inspected by the competent authorities of the country (region) where they are located. After confirming that they meet the registration requirements, they shall recommend and submit application materials to the General Administration of Customs. 

2. Submit

Unless otherwise agreed between the competent authorities of the relevant countries (regions) and the General Administration of Customs on the application method and application materials, the application for registration, change, extension or cancellation of imported food overseas production enterprises shall be submitted through the registration management system of imported food overseas production enterprises.

3. Accept and attend to

After receiving the application materials, the Food Bureau of the General Administration of Customs will deal with them according to the following circumstances:

If the material meets the requirements, it will be accepted;

If the materials do not conform to the legal form or are incomplete, the competent authorities of the country (region) or the overseas production enterprises of imported food shall be informed of all the contents that need to be corrected within 20 working days from the date of receipt of the application materials;

Those who do not belong to the Regulations of the People's Republic of China on the Registration and Administration of Overseas Production Enterprises of Imported Food shall not be accepted and notified to the competent authorities of the country (region) or overseas production enterprises of imported food;

 If it is found that an overseas enterprise has applied for registration to provide false materials, it will not be accepted and the competent authority of the country (region) where it is located or the overseas production enterprise of imported food will be notified; if it is found that the registered overseas enterprise has provided false materials, it shall be in accordance with the Regulations of the People's Republic of China on The relevant requirements of Article 24 of the General Administration Order No. 248 shall be handled.

The Food Bureau of the General Administration of Customs can provide feedback on the acceptance to the competent authorities of the country (region) or the overseas production enterprises of imported food in the form of written letters, fax documents, emails or information systems.

4. Evaluation review

According to the risk analysis and actual work needs, the Food Bureau of the General Administration of Customs may organize an evaluation team to conduct an evaluation review of overseas production enterprises applying for registration of imported food through written inspection, video inspection, on-site inspection and other forms and combinations. The evaluation and review of overseas production enterprises of imported food is as follows:

Written inspection: The General Administration of Customs organizes the review team to inspect the application documents submitted by the competent authorities of the country (region) or overseas production enterprises through the review of the submitted application documents. According to the application documents and materials, the General Administration of Customs may require the competent authorities of the applicant country (region) or overseas production enterprises to supplement the missing information or materials.

Video inspection: The General Administration of Customs organizes a review team to inspect the enterprise's food safety and health management system and its food safety and health status through Internet video connection. Enterprises that receive video inspection and the competent authorities of the country (region) where they are located shall provide necessary assistance for video inspection. For the relevant problems found in the video inspection, the General Administration of Customs may require the enterprises receiving the video inspection and the competent authorities of the country (region) to carry out rectification and submit the corresponding rectification.

 On-site inspection: The General Administration of Customs organizes an evaluation team to go abroad to the on-site site of overseas production enterprises applying for registration to carry out inspection and verification of the enterprise's food safety and hygiene management system and its food safety and hygiene status. Enterprises that accept on-site inspections and the competent authorities of the country region) shall provide necessary assistance for on-site inspection. For the relevant problems found in the on-site inspection, the General Administration of Customs may require the enterprises inspected on the spot and the competent authorities of the country (region) to carry out rectification and submit the corresponding rectification.

The Food Bureau of the General Administration of Customs will organize a review team to carry out video inspection and on-site inspection, which will communicate and negotiate in advance with the competent authorities of the country (region) where the enterprise is located in accordance with risk analysis and international practices.

5. Check

The Food Bureau of the General Administration of Customs reviewed the work report of the review team.

6. Register it.

       According to the evaluation and review, the General Administration of Customs shall register the overseas production enterprises of imported food that meet the requirements and give them a registration number in China, and notify the competent authorities of the country (region) where they are located or the overseas production enterprises of imported food; if the overseas production enterprises of imported food that do not meet the requirements are not registered, the country (region ) Competence authorities or overseas production enterprises of imported food.

     The Food Bureau of the General Administration of Customs may notify the competent authorities of the country (region) or overseas production enterprises of imported food in the form of written letters, fax documents, e-mails or information systems.

III. Change of registration

When the registration of a registered overseas enterprise is changed, the competent authority of the country (region) where it is located or the overseas production enterprise of imported food shall submit the corresponding application materials for change according to the requirements of the application channel.

After evaluation and review, if it is deemed that the change does not involve the food safety and health management control of overseas enterprises (such as the change of enterprise name, etc.), and it is confirmed that it meets the requirements of the change, it shall be changed; after evaluation and review, if it is believed that the relevant change adjustment may affect the food safety and health management control of overseas The competent authorities of the country (region) or the overseas production enterprise of imported food shall submit a new registration application according to the application channel. After the new registration application is approved, the original registration number in China will automatically expire and the registration qualification will be cancelled.

For the relocation of the production site of the enterprise, the change of the legal representative or the change of the registration number granted by the country (region) where the enterprise is located, a new registration application shall be submitted. After the new registration application is approved, the original registration number in China will automatically expire and the registration qualification will be cancelled.

The relocation of production sites refers to the relocation of actual production sites (factory areas) of food exported from China. The change of the office space of the manager does not belong to the relocation of the production site. The change of the legal representative refers to the change in the actual owner of an overseas enterprise. If the actual owner of the overseas enterprise remains unchanged, but the personnel who execute the management of the production site (factory area) of the enterprise on behalf of the actual owner changes, the production enterprise may first apply for a change. The General Administration of Customs evaluates the actual impact of the corresponding change on the food safety and hygiene management control of the enterprise and decides whether to change it.

IV. Renewal of registration

Registered overseas enterprises shall, 3 to 6 months before the expiration of the validity period of their registration, the competent authority of the country (region) or the overseas production enterprise of imported food shall submit the corresponding application materials for renewal of registration according to the requirements of the application channel. 

After evaluation and examination, if it is confirmed that it meets the requirements for renewal registration, the registration will be renewed; if it does not meet the requirements, it will not be renewed and the competent authority of the country (region) where it is located or the overseas production enterprise of imported food will be notified in writing. The original registration number in China will automatically expire and the registration qualification will be

V. Cancellation of registration

When a registered overseas production enterprise of imported food applies for the cancellation of its qualification, the competent authority of the country (region) to which it is located or the overseas production enterprise of imported food shall submit the corresponding application materials for cancellation according to the requirements of the application channel. The Food Bureau of the General Administration of Customs shall notify the competent authorities of the country (region) where it is located or the overseas production enterprises of imported food to cancel the cancellation requirements, and publish it.
